Using KROMA means accepting these rules. They are short on purpose, but they are a contract between you and Strike Gaming Center S.A.S. de C.V., the company that operates KROMA: read them.

Who may use KROMA

You must be at least 13. If you are between 13 and 18, you need permission from a parent or guardian.
You must have legal capacity to accept these terms where you live.
One person, one account. Creating multiple accounts to accumulate points is prohibited.

Your account

You are responsible for your account, your device and everything done from them.
The details you give us must be true. Impersonating another person or a business ends the account.
If you think someone else accessed your account, tell us immediately.

Independence

KROMA is independent and is not sponsored, endorsed by, or affiliated with any team, club, league or federation.
Team and league names are used referentially to identify who you support. We do not use crests, marks or kit imagery.
The colours you see are generated by KROMA and do not reproduce any protected design.

Conduct

Using KROMA to organise, coordinate or call for confrontation, violence or harassment against any person or supporter group is prohibited.
Falsifying your location is prohibited. GPS is validated server-side and accounts that attempt it may be suspended and lose their points.
Automated use is prohibited: bots, scripts, emulators or any means of simulating presence.
You can report and block from within the app. We act on reports.

What you post

Your display name, your reports and your venue notes are your content. You keep ownership of it.
You give us permission to display it inside KROMA in order to run the service. Nothing more.
We may remove content that breaks these rules, without prior notice where the case warrants it.

Your safety away from the app

KROMA shows you where fans are. What you do with that information is your responsibility.
Do not use the app while driving. Do not go into areas you do not know simply because the map has colour in them.
Matchdays can bring tension between rival supporters. You choose where you go and you accept the risk of going there.
KROMA is not an emergency service. If someone is in immediate danger, call your local emergency number.

Venues and third parties

The bars, restaurants and stadiums shown on the map are independent businesses. We do not run them, we do not supervise them, and we are not responsible for what happens in them.
Opening hours, offers and house rules are supplied by the venue and may be out of date. Confirm before you travel.
KROMA relies on third-party services (maps, payments, notifications) that have their own terms.

No wagering

KROMA is not a betting product. There is no real money, no odds, and no betting affiliate links.
In-app predictions are a social game and award points with no monetary value.
Points, areas and prizes are not money, cannot be exchanged for money, and are not transferable.

The game

Points, neighbourhood ownership and weekly decay are game mechanics. We may tune them to keep the map alive.
At the end of the season the map is archived and reset.
If we run prizes, we will publish their rules separately. We may disqualify anyone who cheats.

Venue payments

Subscriptions are billed in advance and renew automatically each month until you cancel. By subscribing you authorise that recurring charge.
No refunds. A charge already taken is not returned, in whole or in part, even if you stop using the service before the period ends.
Cancelling takes effect at the end of the period you have already paid for: you keep the service until that day and are not billed again. We do not cut you off early, precisely because there is no refund.
If a payment fails you get 3 days of grace. During those 3 days you stay on the map and we email you. If it is still unpaid when they run out, the subscription is suspended and your venue stops appearing.
You can pause your subscription; billing stops and your profile is kept, but your venue does not appear while it is paused.
We may change prices with at least 30 days notice. A change applies at your next renewal, never to the period in progress.
Plans are bought and managed on the KROMA website.

No warranty

KROMA is provided “as is”. Map data is aggregated and may be incomplete or delayed.
We do not guarantee the service will be uninterrupted or error-free.
We do not guarantee your check-in will always register: that depends on your GPS, your signal and coverage.

Limitation of liability

To the extent the law allows, KROMA is not liable for indirect, incidental, special or consequential damages, nor for lost profits or lost data.
To the extent the law allows, our total liability to you is limited to what you have paid us in the 12 months before the event or, if you have paid nothing, to MXN $1,000.
None of this limits liabilities that cannot be limited by law, nor your rights as a consumer.

Indemnity

If your use of KROMA, your breach of these rules, or your content leads to a third-party claim against us, you agree to take on that claim and the reasonable costs it causes us.

Suspension and termination

We may suspend or close an account that breaks these rules — with notice where that is reasonable, and without it where there is risk to other people or to the service.
You can delete your account at any time from your profile.
The sections on liability, indemnity and governing law survive the end of your account.

Changes to these terms

We may update these terms. If a change is material, we will show it in the app and ask you to accept it.
If you do not accept, you can stop using KROMA and delete your account.

Governing law

These terms are governed by the laws of the United Mexican States.
Disputes go to the competent courts of Monterrey, Nuevo León, unless consumer protection law where you live gives you a different forum.
In Mexico, PROFECO is the competent consumer authority.

Miscellaneous

If a court strikes down a clause, the rest stays in force.
Not enforcing a right immediately does not mean we give it up.
You may not assign these terms; we may assign them on a merger or sale of the business.
These terms and the Privacy Notice are the entire agreement between you and KROMA.
